Under these Terms, ExpanX grants you a limited, temporary, revocable, non-exclusive, and non-transferable license to access and use the Platform. 2. Services Provided

ExpanX is an online lab-focused marketplace that enables users to:

• Search for lab space listings available for lease or sale

• Search properties by zip code, city, state, and other advanced search criteria

• Save favorite listings

• Use inquiry tools to contact property brokers or owners

• View professional profiles of brokers, property owners and other users

It’s important to note that while we provide the marketplace for search and discovery, the lab spaces featured are not operated by ExpanX; rather, they are listed and managed directly by commercial real estate brokers and property owners. 

We invite commercial real estate brokers and property owners to elevate their lab space listings by joining our premier search marketplace. Our platform is meticulously designed to amplify the visibility of your lab space listings, connecting you with a broader network of prospective tenants, owner users, and investors. By listing with us, you gain access to powerful tools that enhance your property presentations, allowing you to showcase your property images, detailed floor plans, and compelling descriptions that capture the unique value of each space. 

3. Subscription Services

3.1 Subscription Fees

3.1.1 Subscription Plans

Our Services are available on a subscription basis, with options for monthly or annual payments. Details of the available plans and pricing can be found on our Site.

3.1.2 Subscription Term

Subscriptions are either monthly or annually, as selected by you when you upgrade the listing services. Your subscription will automatically renew at the end of each term unless you cancel in accordance with these Terms.

3.1.2 Payment

By subscribing, you authorize us to charge the subscription fee to your payment method on a recurring basis, either monthly or annually, depending on the plan you selected. Payment will be processed through a third-party payment processor, and you agree to abide by their terms and conditions as well.

3.2 Account and Billing

3.2.1 Account Information

To use our Services, you must create an account with us. You are responsible for providing accurate, complete, and up-to-date information during the registration process and for maintaining the confidentiality of your account credentials.

3.2.2 Billing

Subscription fees will be charged in advance for the entire billing cycle. You will receive a confirmation email of your subscription and payment. If your payment method fails or your account becomes overdue, we reserve the right to suspend or terminate your access to the Services until the outstanding payment is resolved.

3.2.3 Changes to Subscription Fees

We reserve the right to change our subscription fees at any time. Any changes will be communicated to you in advance. Continued use of the Services after such changes will constitute your acceptance of the new fees.

3.3 Cancellation and Refunds

3.3.1 Cancellation

You may cancel your subscription at any time through your account settings on our Site or by contacting our customer support. Cancellations are effective at the end of the current billing cycle.

3.3.2 Refunds

Refunds are not provided for any partial periods of the subscription, including unused time. If you cancel your subscription, you will continue to have access to the Services until the end of your current billing cycle, but you will not be charged for subsequent periods.

3.3.3 Trial Periods

If we offer a free trial or introductory offer, the terms of such offers will be specified at the time of sign-up. At the end of the trial period, you will be automatically billed according to the subscription plan you selected unless you cancel before the trial period ends.

3.4 Termination

3.4.1 By Us

We reserve the right to terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. In the event of termination by us for any reason other than a breach of these Terms, we may provide a pro-rata refund for any unused subscription period.

You may terminate your subscription by following the cancellation procedures outlined above. Upon termination, your access to the Services will be terminated at the end of the current billing cycle.

7. Limitations of Liability

To the fullest extent permitted by law, Broadera Platform, ExpanX, and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Site.

8. Indemnification

You agree to indemnify, defend, and hold harmless Broadera Platform, Inc., ExpanX, and its affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of (i) your access to use of the Site; (ii) your violation of these Terms; (iii) your breach of any third party rights, including but not limited to any copyright, property, or privacy rights; or (iv) the content or media that you submit to the Site.
